Article 30. Temporary residence registration

2. Persons who are living, working, working or studying at a location in a commune, ward or township but are not eligible for permanent residence registration in that locality, within thirty days from the date of registration of permanent residence in that locality. On arrival, they must register for temporary residence at the police station of the commune, ward or township.

3. Persons who come to register for temporary residence must present their people’s identity cards or papers certified by the police of the commune, ward or township where they have registered their permanent residence; documents proving the ownership or use of that house; submit a notice of change of household registration, demographics, and demographic declaration; In case the lawful accommodation is a house rented, borrowed or stayed by an individual, it must be approved in writing by the lessor, lent or allowed to stay.

4. The head of the police station of the commune, ward or township within three working days from the date of receipt of all the papers specified in Clause 3 of this Article must issue a temporary residence book according to the form prescribed by the Ministry of Public Security.

Temporary residence books are issued to households or individuals who have registered for temporary residence, are valid for determining the temporary residence of citizens and have a maximum term of twenty-four months. Within thirty days before the expiration of the temporary residence period, the citizen shall go to the police office where the temporary residence book is issued to carry out procedures for extension.

Adjustments to changes in temporary residence books shall comply with the provisions of Article 29 of this Law. If the temporary residence book is damaged, it will be exchanged; if it is lost, it will be re-issued. In case of temporary residence in another commune, ward or township, the registration must be re-registered.

5. If a person has registered for temporary residence but has not lived, worked, worked or studied for six months or more in the locality where he has registered his temporary residence, the agency that has issued the temporary residence book must delete his/her name within temporary residence register.

According to the above regulations, the maximum temporary stay period is twenty-four months (24 months).
